Return Policy

Under Government Emergency Ordinance No. 34/2014 on consumer rights in distance contracts, the Buyer has the right to withdraw from the contract without giving any reason within 14 calendar days of receiving the product. The only costs payable by the Buyer are the direct costs of returning the products.

When exercising the right of withdrawal, the Buyer must return the product in the same condition in which it was delivered, namely:

• In its original packaging;
• Undamaged and showing no signs of use;
• Complete with all original accessories and documents;
• In full working order.

If these conditions are not met, the Seller reserves the right to refuse a refund or reduce the refund amount in proportion to the diminished value of the product.

Products must be returned to NANO BIO MEDICAL SRL at the following address: Intrarea Armasului, No. 12, Apartment 1, Sector 1, Bucharest, Romania, 010484, at the Buyer’s sole expense.

The product price will be refunded within a maximum of 14 calendar days from the date on which the Seller is informed of the decision to withdraw, but not before the returned product has been received and its condition checked.

For orders paid by card, the refund will be credited to the account associated with the card used for payment.

Exceptions to the Right of Withdrawal

Under Article 16 of Government Emergency Ordinance No. 34/2014, the following are excluded from the right of return:

• Products liable to deteriorate or expire rapidly;
• Sealed products that cannot be returned for health protection or hygiene reasons, if unsealed by the Buyer, including medical devices, medical consumables and sterile products. Examples include CPAP machines, CPAP masks, CPAP tubing, oxygen concentrators, Enterosgel, Gloup and humidifier bottles for oxygen concentrators;
• Products made to the Buyer’s specifications or clearly personalised;
• Products specially ordered from a supplier on the basis of a firm order.

Return Policy – Business Customers

In transactions between businesses (legal entities), delivered products cannot be returned, except where approved in advance and in writing by the Seller or in cases of proven non-conformity.

Returns are not accepted for medical products, consumables, sterile products, sealed or unsealed products, special-order products, personalised products or products with a limited shelf life.

Any complaint regarding product non-conformity must be submitted in writing within a reasonable period after receipt and will be resolved in accordance with the contract and the provisions of the Romanian Civil Code.
